Nixon Peabody gains a pair of expert litigators

Firm adds partner and senior counsel to Chicago office | Both bring experience with federal courts and the USPTO in commercial and IP litigation, trade secrets, antitrust, trademarks, unfair competition, and technology licensing matters | Moves follow the recent addition of two associates and of counsel in Washington, DC and LA.

Nixon Peabody has added two veteran litigation attorneys to its Chicago office.

Tim Maloney will join as partner, and Karl Fink becomes senior counsel at the firm.

Both Maloney and Fink bring experience as trial lawyers with a successful track record in litigating all aspects of IP enforcement and defence, with a particular focus on patent litigation.

Seth Levy, the leader of Nixon Peabody’s IP practice, said: “Tim and Karl have earned a formidable reputation for understanding clients’ business needs to implement effective IP strategies, both in terms of litigation and monetisation.”

The pair's backgrounds and experience with federal courts and the US Patent and Trademark Office (USPTO) will be a “valuable benefit” to the firm's clients and colleagues, added Levy.

With more than three decades of experience in IP and technology-related commercial litigation, Maloney has led successful complex cases, including jury trials and Federal Circuit appeals.

He is particularly active in representing patent owners against validity challenges lodged in the USPTO’s Patent Trial and Appeal Board.

Maloney also provides counsel on trade secret, antitrust, trademark, unfair competition, and technology licensing matters, along with assisting in structuring and implementing effective IP strategies in IP-intensive M&A agreements and business transactions.

He has experience in IP monetisation strategies, having assisted companies in building and protecting comprehensive IP portfolios.

Fink's practice includes all aspects of commercial and IP litigation, alongside advising clients on IP valuations, joint ventures, and other related business decisions.

As co-founder of a fitness and physical therapy equipment startup, Fink offers a unique perspective on the IP and business needs of emerging and growing companies.

He has experience enforcing patents for clients with significant market share in their respective industries and has successfully represented clients in state and federal courts across the country, including the International Trade Commission.

Fink has also helped prepare successful arguments in numerous inter partes reviews at the USPTO.

David Brown, managing partner of Nixon Peabody’s Chicago office, described the pair’s experience as a “strong complement” to the firm's attorneys in Chicago and said that their backgrounds “dovetail nicely with our full-service law office, offering opportunities to collaborate with attorneys across practices and industries”.

The latest addition follows last month's arrival of former US District for the Western District of Texas law clerk Nicole Sims as an associate in the firm's Washington, DC office.

The firm also welcomed counsel Michael Gray, who specialises in assisting high-tech clients in litigation and IP protection, and associate Taylor Pfeifer to its Los Angeles office.
