- Patent invalidation win for US medical device company
Jiaquan IP Law assisted a US medical device company back in 2009 with a PCT application in China. In October 2024, the patent faced an invalidation challenge in China, with the petitioner claiming the invention lacked novelty and non-obviousness, and that key features weren’t properly disclosed in the original filing.
Jiaquan successfully defended the patent, drawing on its experience of filing the patent in the first place. All claims were maintained as granted, with the China National Intellectual Property Administration (CNIPA) confirming the patent as valid.
- Patent infringement victory for hardware manufacturer
Jiaquan represented a hardware manufacturer in enforcing a utility model patent against an infringer in China. The defendant was found to have manufactured and sold infringing products, incorporating identical or equivalent technical features of the client’s patented invention, and ordered to pay damages.
