Diageo and Sazerac settle trademark dispute
A trademark infringement dispute between Diageo and Sazerac has been dismissed after both parties agreed to a settlement.
Both parties filed to dismiss the suit, brought by Diageo, on Friday, April 21 at the US District Court for the Southern District of New York.
The financial details of the settlement were not disclosed.
Diageo filed the case in December 2016 and claimed Sazerac had diluted its Bulleit brand by redesigning the bottle and label for a line of its alcohol beverage products, “in order to knock-off the appearance and unfairly trade on the reputation” of the brand.
Diageo was seeking a jury trial, injunctive relief, destruction of infringing materials such as labels, a payment of all profits, damages, triple damages for willful infringement, and costs.
The stipulation and proposed order of voluntary dismissal was approved by US District Judge Paul Gardephe without costs or fees against either party.
