Sheila Swaroop is one of the leading intellectual property litigators in the US. Over more than two decades, she has built a practice representing innovators, technology companies and Fortune 500 businesses in complex patent and trade secret disputes across trial courts, appellate courts, administrative tribunals and the International Trade Commission.
Swaroop has established a reputation for handling high-stakes disputes involving medical devices, consumer electronics and software technologies, combining technical expertise with strategic litigation leadership.
Her recent successes include leading the defence of Veros Credit and two employees in United Auto Credit v Stewart, securing dismissal of all trade secret claims before trial through successful motion practice and summary judgment.
Swaroop also served as lead counsel for Vizio in an inter partes review involving LED brightness control technology, achieving institution on all challenged claims and a final written decision finding every challenged claim unpatentable, eliminating parallel district court exposure.
She represented Masimo in Masimo Corp v Apple, a high-profile dispute involving heart-monitoring technology used in the Apple Watch. Following an eight-day jury trial in the Central District of California, the jury found infringement of all asserted claims and awarded Masimo $634 million in damages. The verdict represented the largest patent damages award in California in 2025 and one of the largest in the medical device sector.
Swaroop is also a longstanding advocate for inclusion. She was the founding member and first woman president of the Howard T. Markey Intellectual Property Inn of Court and has held leadership positions with the Ninth Circuit Judicial Conference, the Association of Business Trial Lawyers, the South Asian Bar Association of Southern California and the Berkeley Law Alumni Board.
