From its eight US offices, Mintz, Levin, Cohn, Ferris, Glovsky and Popeo represents a range of companies in patent litigation, prosecution and portfolio management, and counsels on all aspects of the patent monetisation process. The firm is described as “very good and very prestigious” by a peer, who acknowledges the calibre of the patent practice’s clients. Notable representations in patent matters include for Netlist, Teva Pharmaceuticals, and Citizens Financial Group.

The team’s services include developing portfolio strategies, prosecuting patents, preparing opinions and conducting due diligence. Mintz is noted as being among the top law firms appearing and succeeding in Patent Trial and Appeal Board (PTAB) proceedings.

Mintz litigates in the most active patent venues in the US, as well as handling Section 337 investigations before the International Trade Commission (ITC) for clients; a peer notes the firm is “very active on ITC cases”.

There are over 130 IP professionals in Mintz’s IP team, including more than 40 with PhDs in fields such as biology, biomedical engineering, cellular and molecular medicine, chemistry, and pharmacology, among others.

In mid-2024, the firm added an entire life sciences patent litigation team from Proskauer Rose, led by Siegmund Gutman, who now chairs the firm’s Life Sciences Litigation Practice and co-chairs the Patent Litigation Practice.

Chair of the IP Division Michael Renaud is described by an industry counterpart as “very strategic”, someone who “knows how to find solutions and advise on when to settle”. Renaud advises clients on patent matters both in and out of the courtroom, and has helped his clients realise returns of over $1 billion.

Key matters:

  • Onesta v BMW

Non-practising entity (NPE) Onesta, based in the US and owner of patents covering processor technology, sued BMW in Munich alleging infringement of US patents.

In asserting US patents in Europe, Onesta is possibly the first-known example of a party applying the ‘long-arm jurisdiction’ rules laid down in BSH v Electrolux.

BMW filed a declaratory judgment in Texas requesting emergency relief aimed at preventing adjudication of the US patents in a foreign court.

Judge Alan Albright granted this request; however, after Onesta’s appeal, the Federal Circuit temporarily stayed the injunction.

German firm Peterreins Schley represents Onesta in Germany, and Mintz covers the US proceedings.

  • Amgen v Biocon

Amgen sued Biocon Biologics for allegedly infringing over 30 patents related to bone drugs Prolia and XGEVA. The parties settled in September 2025.

A team from Sidley Austin and Mintz filed the suit on behalf of Amgen.

  • ITC victory for Juul Labs

Michael Renaud led a Mintz team to secure a significant defence victory for Juul labs at the ITC.

The commission affirmed an administrative law judge’s decision that Juul did not infringe on patents held by Altria’s NJOY covering vaporiser and cartridge technology.
