UPC infringement actions total almost 100
Court confirms tally filings and actions since June opening | German location remains by far the most popular venue for litigation | Local Milan division receives three actions.
The Unified Patent Court has published an update on the venue’s filings and actions to date.
Since its launch on June 1 2023, the Court of First Instance has received a total of 274 cases.
Of these cases, 96 are infringement actions, comprising 36 infringement actions filed at the Munich local division, 20 in Düsseldorf, 11 in Mannheim, nine in Paris, five in the Nordic Baltic regional division, and five in Hamburg.
Counterclaims and provisional measures
The local divisions of Milan and the Hague have received three infringement actions each, whereas Brussel, Helsinki, Copenhagen and Vienna have received one infringement action each.
Meanwhile, 129 counterclaims for revocation have been filed with the court’s local and regional divisions. This figure, added the UPC, may be inflated (unless it is noted that each defendant in an infringement case needs to file an individual claim for revocation).
These counterclaims for revocation arise from 39 individual infringement actions.
Elsewhere, the Court of First Instance has received 23 applications for provisional measures, preserving evidence and orders for inspection.
Languages at the court
The Paris central division has received 20 revocation actions while four revocation actions have been filed with Munich’s central division.
To date, the Court of Appeal has received a total of 27 appeals, one request for discretionary review, two applications for suspensive effect and six applications for an order for expedition of an appeal.
German remains the predominant language of proceedings at 48%, while English currently makes up 43% of the language of proceedings at the court
The remainder of proceedings are carried out in French (4%) Italian (3%) and Dutch (2%).
