IKEA vs Vlaams Belang prelim ruling clarifies limits of EU trademark law

The retailer’s lawyer says the CJEU has drawn a line “very clearly” in its preliminary ruling in a closely watched case over a controversial immigration campaign, which forced the Grand Chamber to examine a conflict between fundamental rights. Lawyers from Petillion and Winston Taylor assess a potential framework for balancing trademark rights against political speech, parody and other fundamental freedoms.
