Waco jury awards LED firm $14m in patent suit
Chinese lighting company Zhejiang Super Lighting Electric Appliance has been awarded more than $14 million over the infringement of three patents related to its LED lighting tube patents.
A jury in the US District Court of the Western District of Texas ruled that two other lighting companies CH Lighting Technology and Shaoxing Ruising Lighting should pay Super Lighting $13.87 million for infringing its patents. Another company, Elliott Electric Supply, owes $298,454.
Zhejiang sued the three lighting companies in October 2020, initially claiming that they had infringed four patents related to its technology, all assigned in 2019.
The patents-in-suit were 9,939,140, 10,352,540,10,295,125, and 10,426,003, but the ‘003 patent was later dropped from proceedings.
The Texas jury unanimously agreed that claims of ‘125, ‘540 and, ‘140 patents were valid over prior art and ruled that both CH Lighting and Ruising had willfully infringed the three patents.
However, the jury also held that Elliot had infringed the patents, but not willfully, imposing a lower fine.
Perkins Coie represented Zhejiang in the proceedings, with a team comprised of Wendy Wang, Matthew Bernstein, Joseph Reid, Evan Day, Miguel Bombach and Ruchika Verma.
CH Lighting and Shaoxing Ruising, and Elliot were mainly represented by Holland & Knight attorneys
The jury verdict was handed down on Thursday, November 4.
