Canon files IP patent infringement suit in Russia
Japanese camera manufacturer Canon has filed a patent infringement suit with the Moscow City Economic Court.
It alleged that its Russian Federation patent number 2,467,370, which relates to toner cartridges, has been infringed by distributing companies LLC VTT and LLC Pallady.
According to Canon, the companies are selling certain models of cartridges in Russia (under the names ‘Hi-Black’ and ‘NetProduct’) which infringe its patent.
“Throughout the development, sales and marketing process, Canon respects the IP rights of other companies and individuals and expects others to do the same,” said the company.
Canon hopes to stop the infringement and is claiming damages for patent infringement, in accordance with Russian law.
It continued: “Canon remains committed to taking legal action against anyone who does not respect Canon’s IP rights.”
Last year, Canon was awarded $4.5 million after successfully suing a plastic manufacturer and a toner company for wilfully infringing its ImageRUNNER patent. The US District Court of the Northern District of Georgia found that General Plastic and Color Imaging had infringed the patent.
In its complaint, Canon said: “Defendants market their toner bottle products as purported alternatives to genuine toner bottle products manufactured by Canon and sold under the Canon brand name.”
The jury unanimously agreed that Canon had successfully proven the infringement of the patent.
Canon also sued video surveillance equipment manufacturer Avigilon for infringing five of its patents.
In return, Avigilon filed a complaint for declaratory judgment at the US District Court for the District of Massachusetts claiming that it had not infringed the patents.
