Nike sued over fitness tracker patent

Sports brand Nike is being sued for patent infringement over an app that tracks users’ fitness.

US-based Personal Beasties Group (PDG) alleged that Nike infringes on US patent number 6,769,915, in a case filed at the US District Court for the Southern District of New York on Saturday, January 20.

The patent, known as the “Interactive system for personal life patterns”, covers an app developed by PDG that helps track the fitness goals and achievements of the user.

A motivational animated character appears on the users’ mobile device to help them reach their targets.

Nike was accused of infringing the patent through the sale of Nike+ FuelBand, a personal fitness tracker worn on the wrist that works in conjunction with computer systems and smartphone apps.

The wearer of the band is notified when they achieve a goal and the notification may take the form of an animated character celebrating the users’ achievements.

PDG is seeking damages from Nike.

In September 2017, WIPR reported that the European Patent Office found that a Nike patent protecting breathable sports tops was invalid. Adidas had opposed the patent.

In January last year, Nike secured a permanent injunction against importers Kal American and Capital Freight Management.

The claim said that the companies imported footwear bearing “unauthorised reproductions, copies, counterfeits and colourable imitations” of Nike trademarks.
