Delphine Knight Brown has more than three decades of experience as a high-stakes litigator and trial lawyer. She has tried numerous IP and commercial cases involving a wide range of industries and products, including life sciences companies and luxury goods manufacturers.
Her cases involve both US and international enterprises and primarily focus on patent, trademark and copyright infringement and matters surrounding unfair trade practices, accounting and securities fraud, complex contractual disputes and corporate reorganisations.
She describes herself as “passionate about speaking in community forums in order to collaborate with peers in intellectual property law, and to help shift the paradigm of women doing business in a ‘man's world’. Knight Brown has served as lead counsel in patent litigations, including Hatch-Waxman litigation for several generic pharmaceutical manufacturers. She is also lead litigation and trial counsel representing luxury and consumer goods manufacturers in connection with several patent, trademark and copyright cases.
Representative matters include successfully defending a global pharmaceutical, medical device and healthcare company in arbitration of a $91 million claim involving breach of contract and tort allegations.
Additionally, she brought a patent infringement and misappropriation of trade secrets case against major online shopping platforms on behalf of inventors, involving a portfolio of computer software, hardware and business method patents.
She is a member of various organisations, including the American Intellectual Property Lawyers Association; Women in IP Law Committee and Patent Litigation Committee for the New York Intellectual Property Lawyers Association; the American Bar Association; and the Women Partners’ Roundtable for the New York City Bar Association; and the Women in Fashion Law Group for the National Association of Women Lawyers.
Knight Brown actively supports initiatives that broaden access to the profession, mentors junior lawyers from diverse backgrounds, and participates in industry programmes that encourage underrepresented students to pursue careers in IP and life sciences law.
