Maxell and Asus to settle smartphone patent dispute

Japanese consumer electronics company  Maxell is to settle its patent suit with Taiwanese company  AsusTek Computer.

According to a stipulation issued yesterday, February 28 by a US district court, the two companies have reached an agreement in principle to resolve the dispute.

Maxell sued Asus in October 2017, alleging that the Taiwanese company had infringed seven Maxell patents.

The patents covered smartphone technology including elements of the camera function and data management. Maxell had alleged that Asus products including smartphones and tablets, such as models of the ZenFone and ZenPad, infringed the patents.

Prior to news of the settlement, Maxell had been seeking treble damages for wilful infringement of its patents.

Terms of the settlement have not yet been announced.

The US District Court for the Northern District of California has stayed all deadlines in the case for six weeks to allow the parties time to finalise the settlement.

According to the stipulation, the companies “need additional time to obtain signatures on the now-agreed, finalised memorandum of understanding, and to finalise a settlement agreement”.
