InterDigital reaches settlement with ZTE in 9-year patent dispute

A district judge has dismissed two patent infringement suits between wireless technology company InterDigital and Chinese phone maker ZTE.

On Thursday, January 2, District Judge Richard Andrews of the US District Court for the District of Delaware dismissed the two patent cases, one of which was filed by InterDigital in 2011 and the other filed two years later.

The orders to dismiss came just days after the two parties filed stipulations to dismiss the cases. Back in late November, InterDigital and ZTE told the court that they had reached a licensing agreement and planned to end all legal disputes between them.

The licensing agreement covers the sale of ZTE's 3G, 4G and 5G handsets and tablets along with its high-efficiency video coding technologies used in those devices.

At the time, InterDigital CEO William Merritt said that the deal “also sets a solid foreign benchmark for current and future litigations”.

Aspects of the nine-year battle have been heard before district courts, the US Court of Appeals of the Federal Circuit and the US International Trade Commission.

The patents involved in the dispute are US numbers 7,190,966 and 7,286,847, known as the ‘power ramp-up patents’, and another patent surrounding wireless technology, US number 8,380,244.

Merritt spoke to WIPR last year on the best approach to FRAND licensing. To read more, click here.
