WIPR webinar to provide practical PTAB tips

Kristi Sawert, an administrative patent judge at the Patent Trial and Appeal Board (PTAB), will lead a discussion on how to more effectively present a PTAB case during an upcoming WIPR webinar.

Challenging patents covering unpredictable technologies can be particularly difficult, but the webinar, co-presented with law firm BSKB, can help you evaluate your chances of success.

Presented by attorneys that have successfully argued on both sides of this issue for chemical/pharmaceutical/biotechnology patents, the webinar will take place on October 13 at 11:30 EST/16:30 BST.

The panellists will discuss two to three leading PTAB decisions, including related appeals, which illustrate when obviousness challenges have and have not been successful.

The case discussions will provide (1) a summary of the documentary evidence relied on, including critical excerpts from that evidence, (2) a summary of the “story” that was being told by each party, and (3) the role that expert testimony appeared to play in the PTAB decisions.

Over the course of one hour, panellists will help parties evaluate the chances of success for a contemplated or recently filed PTAB challenge and help parties to a PTAB proceeding develop a record to support their respective positions.

It will also briefly explore what types of cases are better challenged in court and at the PTAB.

Eugene Perez, a partner at BSKB and panellist, has practised in the intellectual property field since 2000, specialising in chemical, pharmaceutical and biotechnology patents.

Perez has argued before the US Court of Appeals for the Federal Circuit, as well as the PTAB.

Gerald Murphy, partner at BSKB and another panellist, has practised in the IP field for 38 years and prosecuted thousands of patent applications.

Murphy has also participated in about 40 inter partes cases before the PTAB and the former Board of Patent Appeals and Interferences.

Earlier this month, WIPR confirmed Sawert as a new speaker. She is an administrative patent judge at the PTAB in Alexandria, Virginia.

Before joining the PTAB, Sawert served as an associate solicitor at the US Patent and Trademark Office’s solicitor’s office.

Sawert will discuss practical tips on how to be more effective when presenting a case to the PTAB.
