Philips wants Xiaomi Indian sales ban

Philips has sued Chinese smartphone maker  Xiaomi at the Delhi High Court, seeking a sales ban on phones which use certain patented 3G technologies.

According to  court documents dated November 27, Philips has asked for an injunction barring the sale of phones using the telecommunications standard. The Dutch electronics company also wants an order directing Indian customs authorities to prevent the importation of such phones into the country.

The Delhi court has ordered Xiaomi to submit details of bank accounts held in India. Philips is seeking information on the revenue earned from Indian sales of the allegedly infringing devices per quarter.

Philips has asserted three patents, covering 3G technologies used by Xiaomi including High-Speed Packet Access (HSPA), HSPA+, and Long-Term Evolution.

It is the latest major patent litigation initiated by the Dutch company, which filed US lawsuits against rivals including LG Electronics, Realtek Semiconductor and MediaTek in September this year.

In those disputes, Philips is alleging infringement of patents covering technology used in high-bandwidth video streaming. The allegedly infringing devices include TVs, smartphones, and computers.

The claims are also being investigated at the US International Trade Commission (ITC), which has the power to ban patent-infringing products from being imported into the US.

In February, Philips also targeted Chinese television manufacturer TCL in a lawsuit over allegedly infringing 4K televisions.

Philips claims TCL rejected repeated attempts by the Dutch company to secure a licence to its IP for use in the TVs.
