ITC to investigate Comcast at TiVo’s request again

The US International Trade Commission (ITC) is once again investigating telecoms company Comcast Corporation at the request of entertainment technology business TiVo Corporation.

The ITC announced its investigation into certain digital video receivers and related hardware and software on Tuesday, March 13.

TiVo filed a complaint with the ITC on February 8, alleging a violation of section 337 of the Tariff Act 1930 and requesting that a limited exclusion order and cease-and-desist orders, be issued.

The patents Comcast is accused of infringing in the lawsuits relate to interactive programme guides, digital storage, transport control interface, and content access. TiVo said that Comcast’s Xfinity range of TV entertainment products are among those which infringe the patents.

This isn’t the first time the ITC has investigated Comcast at the request of TiVo.

In April 2016, Rovi (which acquired TiVo and rebranded to the TiVo name) sued Comcast for patent infringement in two lawsuits and also filed a complaint against Comcast at the ITC.

The ITC found that Comcast’s X1 entertainment box infringed two of TiVo’s patents and ordered the telecoms company not to import or distribute the infringing products in the US.

TiVo said that despite the exclusion order Comcast has continued to make and distribute the infringing products.

The entertainment technology company filed two lawsuits as part of the ongoing battle in January 2018, at the US District Court for the Central District of California and the US District Court for the District of Massachusetts.

As part of the latest investigation, the ITC will assign the complaint to one of its administrative law judges.
