The Trademark Law of the People’s Republic of China was first promulgated in 1982 and entered into force in 1983; it was revised for the first time in 1993 and again in 2001. The third amendment has been under discussion since 2003.
In 2009, State Administration for Industry and Commerce (SAIC) under the State Council of China submitted Trademark Law of the People’s Republic of China (draft for comments) to the Legislative Affairs Office of the State Council. On September 2, 2011, the revised draft was posted in Chinese online for public comments until October 8, 2011.
