USITC to investigate complaint by General Electric
The US International Trade Commission (USITC) has unveiled three investigations this week.
It will investigate a complaint filed by General Electric (GE) filed on July 31, which alleged that renewable energy company, Siemens Gamesa, violated section 337 of the Tariff Act of 1930 by importing speed wind turbine generators into the US that infringed its patents.
The second investigation is based on a complaint filed by electric motor company Regal Beloit America on July 31, which held that Atlanta-based East West Manufacturing and East West Industries of Vietnam infringed its patent for blowers by importing products for sale into the US.
The third investigation is based on a complaint filed by Steel Technology and Texan company, Helen of Troy, on July 29, 2020, which claimed that their patents for vacuum insulated flasks were infringed.
The companies to be investigated include Chinese companies: Everich and Tomic Houseware,Cangnan Kaiyisi E-Commerce Technology, and Shenzhen Huichengyuan Technology, and US companies: Eddie Bauer, PSEB Holdings and HydroFlaskPup.
All complainants have requested that the USITC issue exclusion orders and cease and desist orders.
The USITC’s chief administrative law judge will assign the case to one of the USITC’s administrative law judges (ALJ), who will schedule and hold a hearing. The ALJ will decide whether there is a violation of section 337, which is subject to review by the commission.
USITC remedial orders in section 337 cases become final 60 days after issuance unless disapproved for policy reasons by Robert Lighthize, the US Trade Representative, within that period.
