Samsung and Huawei settle in China
Huawei and Samsung have settled all patent infringement disputes between the two companies in China.
Yesterday, May 14, Chinese state-run news agency Xinhua reported that a local Chinese court had made the announcement.
According to the Guangdong High People’s Court, China-based Huawei has reached a patent permission agreement with Samsung that will serve as a framework for global cross-licensing between the companies.
The terms of the agreement have not been made public.
The reports said Samsung and Huawei have both started withdrawing relevant charges against one another.
In February this year, WIPR reported Samsung and Huawei had asked a US court to stop patent infringement proceedings between the pair after entering into a settlement agreement.
The companies were set to go to jury trial in September this year, after Samsung alleged that Huawei breached its FRAND (fair, reasonable and nondiscriminatory) licensing obligations.
Matt Murphy, a managing partner at MMLC in China, said it was just a matter of time before the court action in China settled, after the companies agreed to settle patent litigation in the US.
Murphy said: “It is expected that a number of cross licenses involving patent royalties have been or are currently being negotiated, so that all relevant patent litigation cases can be settled.”
Huawei is yet to confirm the reports of the settlement.
