PTAB upholds Motorola patents in Hytera dispute

The US Patent Trial and Appeal Board (PTAB) has issued two decisions in an ongoing dispute between Motorola and radio systems manufacturer Hytera.

In a statement on Friday, May 10, telecoms equipment provider Motorola said the PTAB had upheld the validity of two of its patents after an inter partes review.

It said the PTAB rejected all validity challenges against its patent—US number 8,116,284—which were raised by Hytera.

Additionally, the PTAB also upheld several claims of another Motorola patent (US number 6,591,111).

The patents were challenged by Hytera after the US International Trade Commission (ITC) ruled that one of Hytera’s radio products infringed four Motorola patents. The product in dispute was Hytera’s two-way digital mobile radio (DMR).

Motorola said the two patents enable “important functionality” and provide its product with “highly reliable, secure communications that customers rely on”.

Mark Hacker, general counsel and chief administrative officer of Motorola, said the decisions “underscore the strength of Motorola’s IP”.

Hacker said: “We remain committed to vigorously pursuing our patent infringement, copyright infringement and trade secret theft lawsuits against Hytera as we continue developing unique, innovative products for our customers around the world.”

This is the latest ruling in a worldwide dispute.

In November 2018, WIPR reported that a German court had issued injunctions against Hytera after finding that its DMR infringed one of Motorola’s European patent.

Earlier that month, the US ITC issued a notice of final determination that some of the Chinese company’s products infringe Motorola patents, but that Hytera’s new-generation i-Series devices do not and could continue to be imported and sold in the US.
