Intellectual Ventures wins $43 million patent claim against T-Mobile and Ericsson
A jury has awarded IP licensing company Intellectual Ventures $43 million after finding telecoms companies T-Mobile and Ericsson infringed three of its patents.
The verdict, announced yesterday, February 20, by Intellectual Ventures’ counsel, said T-Mobile and Ericsson had infringed patents used for wireless services for the long-term evolution network (LTE).
The patents in dispute were US numbers 6,628,629; 7,412,517, and RE46,206.
T-Mobile and Ericsson had challenged the claims of the ‘206 and ‘629 patents as patent-ineligible subject matter, but the jury determined that the companies “failed to provide convincing evidence” that the claims in Intellectual Ventures' patents were invalid.
In its February 8 decision, a US District Court for the Eastern District of Texas jury awarded Intellectual Ventures $34 million against T-Mobile and $9 million against Ericsson.
Johnny Ward, counsel at Ward, Smith & Hill in Texas, who represented Intellectual Ventures, welcomed the jury’s decision.
"This verdict shows you can't infringe on another company's patents and expect to get away with it,” Ward said.
The case dates to September 2017, when Intellectual Ventures said T-Mobile and Ericsson performed methods claimed by its patents during the installation, testing and operation of the T-Mobile network.
