Russian court revokes Samsung import ban amid patent row

Samsung has secured a win in Russia after a Moscow court reversed its previous ruling preventing the electronics company from importing and selling 61 smartphone models throughout the country.

The Moscow Arbitration Court delivered the decision on January 27, which was first reported by Russian media outlets and then Reuters on Monday January 31.

Background

The dispute stems from a complaint filed by financial services and mobile payment company SQWIN in February last year alleging that the electronic payment system, Samsung Pay, infringes on its Russian patent, number 2686003.

The Switzerland-based company claimed that Samsung infringed by using SQWIN’s patent for a payment transaction system enabling customers to use their smartphones and other Samsung devices to pay for goods and services online.

In July 2021, the Moscow court found in favour of these arguments and three months later issued a list of 61 smartphone models that South Korean company should be barred from importing, storing or selling in Russia.

‘Invalid patent’

According to Russian media, the decision prohibited the supply and sale of Samsung Galaxy Z Flip, Samsung Galaxy Fold, Samsung Galaxy Z Fold 2, Samsung Galaxy S21, Samsung Galaxy S21+, Samsung Galaxy S21 Ultra 5G, Samsung Galaxy S20 FE, Samsung Galaxy S20, Samsung Galaxy S20+, Samsung Galaxy S20 Ultra, Samsung Galaxy S10e, Samsung Galaxy S10, Samsung Galaxy S10+, Samsung Galaxy S10 Lite, Samsung Galaxy S9, Samsung Galaxy S9+, Samsung Galaxy S8 models and some others.

In November, Samsung petitioned the Chamber of Patent Disputes of the Russian IP Office, Rospatent, holding that it could not have infringed SQWIN’s patent because it was invalid.

On Thursday, the Moscow Arbitration Court was reported to have reversed its ruling, on the basis that SQWIN SA had failed to show that Samsung had acted in bad faith.

According to reports, it is as yet unclear whether the listed models had been withdrawn from the marketplace since October’s order.
