Lusheng successfully leveraged China’s revised ‘Seed Law’ to achieve a rare punitive damages award, effectively doubling the illegal revenues generated by the infringer. The ruling also clarifies the scope of PVR protection, extending it to harvested fruit and setting a precedent for both domestic and international PVR holders.
