Western Digital targeted in patent infringement suit
US-based computer data storage company Western Digital has been named in a patent infringement lawsuit by a Texas-based company.
MobileExp filed its lawsuit (pdf) at the US District Court for the Eastern District of Texas, Marshall Division, on Wednesday, November 30.
The case centres on US patent number 8,879,246, titled “Peripheral data storage device” and which was published at the US Patent and Trademark Office in November 2014.
The patent covers a peripheral data storage device for the iPhone and iPod, and uses electronic circuits to communicate with the device.
According to the suit, Western Digital infringed claims 1, 2, 6 and 9 of the ‘246 patent through USB sticks sold by its subsidiary SanDisk. The allegedly infringing products include SDIX30C-016G-AN6NN, SDIX30C-032G-AN6NN and SDIX30C-064G-AN6NN.
MobileExp said that the data storage company is “directly” and “literally” infringing its patent through the sale of its products.
The company added that it will “continue to suffer damages” in the future.
MobileExp is asking for injunctive relief, damages, costs, expenses, pre- and post-judgment interest and a jury trial.
