Apple and Samsung top IPR petitioner list, says report

Technology companies Apple and Samsung have topped the list of most active petitioners in inter partes review (IPR) proceedings, according to a report.

Patexia, an online patent research platform, released its first IPR intelligence report yesterday, September 19, detailing the findings.

Apple topped the list of petitioners with almost 5% of all cases filed before the Patent Trial and Appeal Board (PTAB).

As of the end of the second quarter this year, there were 6,580 IPR challenges filed before the board.

Apple filed 298 of these petitions, followed by Samsung with 216 cases and Google with 130. The top five petitioners have been involved in around 14% of all challenges.

However, the most active companies are not necessarily the best performing—in the second quarter of 2017, semiconductor company GlobalFoundries filed 23 IPR petitions and ranked first with a performance of 100%.

Gillette, Dell EMC, non-practising entity Finjan, and Volkswagen took the other spots in the top five.

Fish & Richardson was the most active law firm with 625 IPR challenges, followed by Sterne Kessler Goldstein & Fox (558), Finnegan, Henderson Farabow, Garrett & Dunner (473), WilmerHale (348) and Oblon, McClelland, Maier & Neustadt (298).

Together, the firms have been involved in 2,302 IPR cases.

Pedram Sameni, Patexia’s founder, said: “As we move toward the knowledge-based economy, intellectual assets and patents in particular are becoming more important than ever.”

Sameni added: “With a record-breaking number of IPR challenges expected to be filed this year, it is crucial for petitioners and patent owners to understand this growing market better and make informed choices about their service providers.”
