WIPR survey: Readers prepared for new EU trademark system

WIPR readers are prepared for the new EU trademark reforms, which came into effect on March 23, according to our recent survey.

On March 23, WIPR  reported that the EU trademark reforms, including reduction in renewal fees and a re-branding of the Office for Harmonization in the Internal Market to the European Union Intellectual Property Office, had been implemented.

Community trademarks are now known as European Union trademarks, and renewal fees have been reduced from €1,500 ($1,680) to €850 for electronic filing, and €1,500 to €1,000 for paper filing.

In total, 68% of readers said they are prepared for the new changes.

“I already advised my clients on the changes about six weeks ago,” one reader noted.

“I’m a professional who has to advise clients about the changes. Not being adequately prepared for the changes would be negligent,” another said.

For this week’s survey, we ask: “Last week, we reported that an online cooking channel had its trademark application for ‘Jaws’ rejected because people may confuse it with the film star shark of the same name. Is the term ‘Jaws’ immediately associated with the movie regardless of the class of goods applied for? Please explain your answer.”
