WIPR survey: Readers call on SCOTUS to reverse Halo and Stryker rulings

WIPR readers have said the US Supreme Court should overturn lower court rulings in two patent infringement cases that centre on enhanced damages.

Responding to WIPR’s most recent survey, 66% of readers said they thought the US Court of Appeals for the Federal Circuit’s rulings on enhanced damages in the Halo v Pulse and Stryker v Zimmer cases should be overturned.

Earlier this month the Supreme Court heard oral arguments in the cases, which have been consolidated.

Both plaintiffs are seeking a ruling from the Supreme Court that rejects the federal circuit’s decisions to deny them enhanced damages.

The federal circuit rejected the claims because of its two-part test for determining whether infringement was wilful.
