Toshiba in patent spat with Spex Technologies

Multinational conglomerate Toshiba has been targeted by California-based Spex Technologies in a patent infringement lawsuit.

The suit, filed on Wednesday, September 28 at the US District Court for the Central District of California, Southern Division, claimed that Toshiba has infringed two of Spex’s patents.

The patents, US numbers 6,088,802 and 6,003,135, concern encrypted devices.

Spex also alleged patent infringement against computer storage manufacturer Apricorn and encryption developer CMS Products on the same day.

The company claimed that Toshiba has infringed the patents by selling encrypted USB drives and hard drives.

“Defendants actively, knowingly, and intentionally induce, and continue to actively, knowingly, and intentionally induce, infringement … by their customers and end users,” said the suit.

Spex is seeking a jury trial, triple damages for wilful infringement and attorneys’ fees.

The company was formed to license technology developed by Spyrus, an encryption company.
