Samsung agrees to $548m Apple payment

Samsung has agreed to pay Apple $548 million to settle its long-running patent infringement dispute with the rival company.

A joint case management statement filed at the US District Court for the Northern District of California on Thursday, December 3, revealed that Samsung has agreed to pay Apple within ten days of receiving an invoice.

Samsung said it would pay the amount by December 14 if Apple had sent its invoice by December 4.

In September, WIPR reported that Judge Lucy Koh at the California district court had affirmed the $548 million ruling in favour of Apple.

Koh denied Samsung’s request to either stay the judgment or institute a new trial.

The ruling stems from a 2012 decision that initially saw Samsung fined $930 million.

The US Court of Appeals for the Federal Circuit, following Samsung’s appeal against the ruling, upheld $548 million for patent infringement but vacated $382 million from the 2012 ruling that had centred on trade dress dilution.

According to reports, Samsung has told Apple it reserves the right to a refund if any of the damages are overturned pending an appeal to the US Supreme Court or if any of the patents are invalidated by the US Patent and Trademark Office.

The USPTO is currently reviewing one of the patents included in the case.

A spokesman for Samsung said: “While we’ve agreed to pay Apple, we remain confident that our products do not infringe Apple’s design patents, and we will continue to take all appropriate measures within the legal system to protect our products and our intellectual property.”
