Motorola Solutions files patent complaint against Hytera at USITC

Communications company Motorola Solutions has filed a patent infringement complaint against China-based Hytera at the US International Trade Commission (ITC).

Motorola Solutions filed the complaint yesterday, March 29, arguing that Hytera had infringed US numbers  8,116,284, 8,279,991, 7,369,869, 8,032,169, 7,729,701, 9,099,972 and 6,591,111.

The patents relate to two-way radio equipment systems and related software.

Motorola Solutions argued that Hytera infringed the patents through products such as Hytera BD302, BD502, PD362 and PD412.

The company asked for a permanent exclusion order against Hytera, a permanent cease-and-desist order, and any other relief that the ITC deemed just and proper.

On March 14, Motorola filed a patent infringement and trade secret suit against Hytera at the US District Court for the Northern District of Illinois, arguing that Hytera had wilfully infringed and brazenly copied its IP.

The patents named in the suit are the same as those in the ITC complaint.

In the district court, Motorola Solutions asked for damages, pre- and post- judgment interest, expenses, costs and attorneys’ fees, and a jury trial.

Mark Hacker, general counsel and chief administrative officer of Motorola Solutions, said in a release issued by the company yesterday: “Hytera asserts that it embraces legitimate competition, but there is nothing legitimate about the illegal copying and misappropriation in which it has engaged."

He added that Motorola looks forward to a “full and fair hearing” before the ITC, as well as the federal district court in Chicago.

Hytera said in a statement published today: “Motorola’s new action continues its pattern of legal manoeuvring instead of competing with Hytera in the marketplace.

“The case at the ITC covers the same subject matter and addresses the same patents as the cases filed in mid-March. Hytera will defend itself against these allegations, and we are fully confident that we will prevail.”
