Merck & Co released from patent suit on barcode technology

Merck & Co has been released from a patent infringement case brought by US-based company Symbology Innovations, which alleged that Merck had infringed its patents covering quick response (QR) technology.

Symbology filed a notice of dismissal with prejudice yesterday at the US District Court for the District of New Jersey.

Merck was sued in March this year for allegedly infringing four of Symbology’s patents: US numbers 8,424,752; 8,651,369; 8,936,190; and 7,992,773.

According to the complaint, Merck had used the QR technology in its company literature.

QR codes are 2D barcodes that can be read by smartphones and other devices.

Symbology initially said in its complaint: “Symbology will continue to suffer damages in the future unless defendant’s infringing activities are enjoined by this court.

“As such, Symbology is entitled to compensation for any continuing and/or future infringement up until the date that defendant is finally and permanently enjoined from further infringement.”

But in the notice to dismiss, it was clarified that each party will bear its own attorneys’ fees and costs.
