WIPR assesses five of the best sessions at the LES 2015 Annual Meeting, which is taking place in New York from October 25 to 28.
What: Cost, market, income—valuation frameworks for licensing
When: Sunday, October 25—14:00 to 17:00
Who: Robert Goldman, Charles River Associates; Chris Schulte, 284 Partners
Titled “What is it worth?”, this workshop examines how to provide a framework for evaluating IP valuation questions.
Through demonstrations, group discussions, and case studies it aims to focus on how licensing executives can employ a combination of the cost, market, and income approaches to conclude a valuation.
There will also be discussions about the theories underlying the approaches to tackling IP licensing, as well as mitigating information shortfalls.

How is money changing the financial climate for innovation?
This cross-industry panel of experts will discuss how money is affecting innovation. The session will discuss what stakeholders are doing and how investment and licensing are shaping innovation.
What: Post-grant proceedings as the new frontline: impacts and future trends of legislation and case law on licensing and innovation
When: Tuesday, October 27—14:00 to 15:15

To date more than 1,000 petitions for post-grant proceedings have been filed, mostly by defendants in co-pending patent infringement actions.
And recently organisations tied to private funds have been seeking to invalidate patents covering pharmaceutical products.
The panel, which includes Steven Klocinski of MasterCard and Paul Richter from law firm Kenyon & Kenyon, will address relevant and current trends in post-grant review and case law, as well as how universities and corporations are responding to these changes.
What: Licensing standard-essential patents
When: Wednesday, October 28—10:45 to 12:00
Who: Roberto Dini, president, LES Italy (moderator); Carter Eltzroth, DVB Project; John Paul, Finnegan, Henderson, Farabow, Garrett & Dunner
Speakers on this panel are Carter Eltzroth from broadcast consortium company DVB Project and John Paul from law firm Finnegan.
They will discuss factors currently being considered when defining a fair, reasonable and non-discriminatory royalty rate and the ways patent pools and standard-setting organisations can work together to address licensing and payments in a more efficient way.
The session will also discuss the enforcement of standard essential patents to avoid distortions on the market, such as the use of injunctions against any unwilling licensees.
What: Improv theatre: when good deals go bad—a look at trade secrets
When: Wednesday, 28 October—10:45 to 12:00
Who: Louise Levien, ExxonMobil Upstream Research Company; Ada Nielsen, Foodexus; John Somich, BP
This is billed as a “theatrical performance” that will focus on trade secrets and how, when treated improperly, they can lead to a good deal going bad.
Panel members are expected to play different roles of parties involved in an agreement, with the aim being to demonstrate how trade secrets can be inadvertently disclosed even when the best processes are in place to protect them.
