ITC to investigate Memory Technologies complaint against SanDisk
The US International Trade Commission (ITC) has voted to investigate whether certain flash memory devices infringe patents owned by Memory Technologies, a subsidiary of non-practising entity Pendrell Corporation.
In December last year, Memory Technologies filed a complaint at the ITC, alleging violations of section 337 of the Tariff Act of 1930.
According to the complaint, SanDisk and Western Digital had imported flash memory devices and components into the US, infringing five of Memory Technologies’ patents.
The patents, which relate to flash memory technology, are US numbers RE45,542; RE45,486; 7,565,469; 9,063,850; and 8,307,180.
Memory Technologies requested that the ITC issue a limited exclusion order and cease-and-desist orders.
The ITC’s chief administrative law judge will assign the case to one of the agency’s administrative law judges (ALJs), who will schedule and hold an evidentiary hearing.
Then, the ALJ will make an initial determination of whether there is a violation of section 337, with the initial determination subject to review by the commission.
Memory Technologies also filed a patent infringement claim on December 6 at the US District Court for the Central District of California, Southern Division, against SanDisk and Western Digital.
