ITC to investigate Apple over Nokia complaint

The US International Trade Commission (ITC) has revealed plans to investigate a complaint made by Nokia alleging that Apple has imported patent-infringing phones, tablet computers and components.

Nokia took on Apple in a series of patent suits filed worldwide focusing on iPads and iPhones in December last year.

WIPR reported that 40 patents were involved in the actions, “covering technologies such as display, user interface, software, antenna, chipsets and video coding”.

Nokia filed actions in 11 countries: Germany, Finland, the UK, Italy, Sweden, Spain, the Netherlands, France, Hong Kong, Japan and the US.

It also filed an action with the ITC, claiming that Apple had violated section 337 of the Tariff Act of 1930 by importing infringing goods into the US.

Nokia asked the ITC to issue a limited exclusion order and a cease-and-desist order.

The ITC’s chief administrative law judge will assign the case to one of the agency’s administrative law judges (ALJs), who will schedule and hold an evidentiary hearing.

Then, the ALJ will make an initial determination of whether there is a violation of section 337, with the initial determination being subject to review by the commission.
