H&M and Deckers settle UGG trade dress and patent suit

Retailer H&M and footwear designer Deckers have settled a patent and trade dress infringement lawsuit concerning UGG boots.

US District Judge Fernando Olguin signed the order dismissing the claim without prejudice on Thursday, April 20.

Deckers filed its claim in January at the US District Court for the Central District of California, alleging that H&M had infringed a design patent, US number D599,999, and trade dress covering Deckers’ UGG boots.

H&M was alleged to have sold boots that infringed UGG’s “Bailey Button” product, a suede boot with buttons placed on the outside.

“Deckers is informed … that defendant is a competitor and has copied Deckers’ boot designs in an effort to exploit Deckers’ reputation in the market,” said the claim.

At the time, Deckers was seeking temporary, preliminary and permanent injunctive relief, an award of profits, triple damages, a recall of infringing products for destruction, and a jury trial.
