Are you a birdbrain?

Would you confuse the trademarks ‘Super Bowl’ and ‘Superb Owl’? The Night Run (the applicant for the latter) clearly doesn’t think so—calling the National Football League’s (NFL) recent opposition to it “rather silly”—and while it might be tempting to agree, the marks are visually quite similar. Not only that, but the NFL is legally obliged to protect its trademarks and would therefore argue that it must stamp out any source of potential confusion or infringement, however minor it may seem.
