Fisher-Price and Mattel sue over children ride-ons
Fisher-Price and Mattel, US companies that produce toys for children, have filed a complaint against a company producing bicycles and electric ride-ons for patent infringement.
The case, which was filed on Tuesday, January 17 in the US District Court for the District of Delaware against Dynacraft, centres on its ride-on products including the 24V Disney Princess Carriage which allegedly infringe Mattel’s US patent numbers 7,222,684; 7,487,850; 7,621,543; and 7,950,978.
Mattel has granted Fisher-Price an exclusive licence to the four patents.
According to the complaint, Dynacraft released the accused products just as Fisher-Price was releasing its patented product.
The accused products infringe the patents because they contain components to generate “soft-start acceleration”, according to the complaint.
The suing companies also claimed that Dynacraft released the accused products without rights to certain Fisher-Price and Mattel shifter and wheel patents.
Fisher-Price and Mattel have asked the court for a judgment in their favour, as well as a permanent injunction enjoining Dynacraft from selling its accused products.
The companies have also asked to be awarded damages and have demanded a trial by jury.
